Military Divorce Laws In Orlando

Military divorce law in Florida is different from that of other states because the federal Servicemembers Civil Relief Act (SCRA) specifically applies to all jurisdictions within the United States. In order for the protection afforded to military personnel under the SCRA to apply, the servicemember must have been residing in Florida at some point during the deployment.

Provisions Of SCRA In Florida

The provisions of the SCRA offer both short-term and long-term protection against many day-to-day civil court proceedings that can affect a service member’s legal rights while on active duty. This is because such proceedings require the service member to either appear in court or respond to the legal action. Protections under the SCRA are available for any active duty authorized by Title 10 of the United States Code, including Title 10 orders for a servicemember to report for initial Active Duty Training (aka Boot Camp), annual training, pre-deployment training, and post-deployment training, even if the service member has not yet received an official military order authorizing these periods of duty.
